Over $70,000 worth of goods from FulLife Natural Options, Inc. of Boca Raton, Fl were seized by U.S. Marshals last Tuesday at the request of the U.S. Food and Drug Administration (FDA).
The main products in question were Charantea Ampalaya Capsules and Charantea Ampalaya Tea, goods labeled as dietary supplements yet promoted as treatments for such conditions as diabetes, anemia, and hypertension. Unfortunately, it is these latter claims that has the FDA up in arms.
A formal complaint was filed by the U.S. Attorney’s Office for the Southern District of Florida which accused the products of violating drug and misbranding provisions set forth by the FDA. As is standard practice, any goods making claims relating to the prevention or treatment of disease must be subject to regulation as drugs. Despite FDA warnings, FulLife failed to bring its marketing into compliance with the law and continued to market the products as usual.
The FDA considers these products to be unapproved new drugs because they make claims related to disease prevention and treatment. However, every new drug product must be first approved by the FDA for safety and effectiveness before they are legally permitted on the marketplace. Consequently, as FulLife Natural allowed its website to post statements concerning the therapeutic value of the Charantea products, the FDA was forced to take action.
